PROCEDURE OF REGISTRATION OF LLP IN INDIA
- Documents required- Every proposed partner must have PAN Card as an Identity proof, one address proof (Utility bills not older than 2 months like telephone bill, electricity bill) and two recent passport size photos. Duly self-attested photo copies of PAN Card & address proof are required.
- DPIN Application & Digital Signature- After verifying above documents, application is made for DIN and Digital Signature.
- Check Name Availability- Name availability is checked to make sure that there is no company or LLP registered with the same name. Trademark is also checked for similar purpose.
- Name application- After checking name availability, application is made to ROC for proposed name.
- Drafting LLP Agreement- This is drafted from the information given by the partners such as Capital contribution, profit sharing ratio, Address and nature of business, Rights and duties of partners.This is done in accordance to LLP Act, 2008.
- Signing Agreement- After drafting, the partners are required to sign the LLP Agreement if it is approved. Stamp duty is also paid.
- E-Forms- After this, e- forms are filed for incorporation of the LLP along with the LLP agreement.
• Certificate of Incorporation- After this the certificate of commencement is issued by the ROC.
