
Company Registration
Company is an association of persons coming together for a common purpose. Thus, a company is an association of people who come together to contribute a sum of money for the purpose of carrying out business activities. Companies in India are registered under Companies Act, 2013. Companies hold a separate legal identity distinct from its owners in the eyes of law.
PROCEDURE FOR REGISTRATION OF COMPANY IN INDIA
- Documents requirement- Every proposed Director must have PAN Card as an Identity proof, one address proof (Utility bills not older than 2 months like telephone bill, electricity bill) and two recent passport size photos. Duly self-attested photo copies of PAN Card & address proof are required.
- DIN Application & Digital Signature- After verifying above documents, application is made for DIN and Digital Signature.
- Check Name Availability- Name availability is checked to make sure that there is no company or LLP registered with the same name. Trademark is also checked for similar purpose.
- Name application- After checking name availability, application is made to ROC for proposed name through RUN or in Form Spice.
- E-Forms and Drafting of MOA and AOA – After the name approval application is made for registration of the new company by filing the required e- forms within 15 days of name approval along with the requisite fees.
- Certificate of Incorporation- After this, the certificate of commencement is issued along with CIN, DIN, PAN, TAN of the company and a corporate identity is created.
